These Terms of Service ("Terms") govern your use of Pato Market (patomarket.net), a platform that lets creators sell digital products and lets buyers purchase them. By creating a store, listing a product, or making a purchase on Pato Market, you agree to these Terms.

1. What Pato Market is

Pato Market is a marketplace that lets sellers ("Creators") upload and sell digital products, such as ebooks, courses, templates, coaching, and similar files, directly to buyers ("Buyers"). Pato Market provides the storefront, checkout, and file delivery infrastructure. Creators are responsible for the content, quality, and accuracy of the products they list.

2. Creator accounts

To sell on Pato Market, you must create an account and a store. You are responsible for keeping your login details secure and for all activity under your account. You must provide accurate information about yourself and your products.

3. Fees

Creating a store on Pato Market is free. Pato Market charges a 6% platform fee on each sale. In addition, our payment provider (Paystack) deducts its own payment processing fee from every transaction, which varies depending on the payment method the buyer uses (for example, M-Pesa or card). This processing fee is separate from Pato Market's platform fee and is not set or controlled by Pato Market. Your earnings shown after a sale reflect both fees. There are no listing fees or monthly charges beyond this.

4. Product listings

By listing a product, you confirm that:

• You own the rights to the content, or have permission to sell it
• The product does not infringe on anyone else's copyright, trademark, or other rights
• The description and price you provide are accurate
• The file you upload is what buyers will actually receive

Pato Market reserves the right to remove any listing that violates these Terms, without prior notice, and to suspend accounts that repeatedly violate them.

5. Prohibited content

You may not list or sell products that:

• Contain illegal content of any kind
• Infringe on someone else's intellectual property
• Are sexually explicit or exploit minors in any way
• Promote violence, hate, or discrimination
• Are fraudulent, misleading, or do not deliver what is described

Our Acceptable Use Policy covers content and conduct standards for both Creators and Buyers in more detail, and works alongside these Terms.

6. Payments and payouts

Buyer payments are processed through Paystack. Pato Market does not store your card details. Payouts to Creators are made to the mobile money or bank account details provided during account setup. Payout timing depends on Paystack's standard settlement schedule.

7. Refunds

Because Pato Market sells digital products delivered instantly by download, all sales are generally final. If a Buyer did not receive a working download link, or the file is broken or does not match the listing, they should contact the Creator directly, or reach out to hello@patomarket.net for help resolving the issue.

8. Buyer responsibilities

Buyers agree to provide a valid email address to receive their download link, and to keep purchased files for personal use unless the Creator's listing states otherwise. Redistributing or reselling purchased digital products without the Creator's permission is not allowed.

9. Account termination

Pato Market may suspend or close any account that violates these Terms, engages in fraud, or misuses the platform. Creators may close their own store at any time by contacting hello@patomarket.net.

10. Limitation of liability

Pato Market provides the platform "as is." We are not responsible for the content, quality, or legality of products listed by Creators, or for disputes between Creators and Buyers. Pato Market's liability in any matter is limited to the fees paid to Pato Market for the transaction in question.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of Pato Market after changes are posted means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Kenya.
